Sounds good, however further confrontation from your account will result in you being banned. If you do find a copyrighted image that you own, I'll say once more, just use the official channels.

To be honest - I do not want to be a part of this community. I don't like it. However, I will leave my account open because I will be checking here regularly for copyright violations on my images and if and when I do find one you can be sure that I will report it !

I will confirm that I have acted appropriately on the Private Message you reported yesterday, though to protect the personal privacy of our members, I cannot disclose the action taken.

If you do not have any personal copyright violations to report, I don't feel you are longer welcome on Deskop Nexus due to your argumentative and confrontational personality. I am NOT saying others aren't guilty as well, however you are the one who has been loudest to me, so I am simply voicing my opinion. You have your own wallpaper site... why not return there and leave our community in peace. I think that'd be best for all parties involved, as well as being a better use of your (and our) time.

Oh, and by the way, have you acted on that message that I reported a violation on yesterday? The profanaties, threats and insults were surely a violation??? I went throught the proper channels and used the REPORT VIOLATION button but have no confirmation of any action being taken. Especially since I cannot respond (not that I would want to) since this person has blocked me, which is contradictory of her sending me a message.

Seems too much one-way traffic here.

But if you'd been following this circus since the start you would know that this all started when one of your members had posted an artwork created by a friend of mine. I merely made a comment on that post that it had been stolen and named the artist who the work belonged to. That resulted in many aggressive messages full of threats, insults and disgusting language from the thief. I CANNOT report DMCA on images that I do not hold copyright on.

Yes, nothing is sorted out because you will not use the official channels, so I cannot legally help you.

There are bigger sites than ours who deal with artists every day.

For example, if you find your copyrighted picture on Flickr, they make you go through the same process: http://info.yahoo.com/copyright/us/details.html
If you find your image on Google Picasa, they make you fill out a similar form: http://picasa.google.com/support/bin/request.py?contact_t...
For Photobucket: http://photobucket.com/copyright
For YouTube: http://www.youtube.com/copyright_complaint_form
For Facebook: http://www.facebook.com/legal/copyright.php?copyright_not...
and I could go on and on.

Bottom line, EVERY major site requires you (as a copyright holder) to follow similar processes for getting your content removed. The Digital Millennium Copyright Act of 1998 clearly states that the burden of identifying alleged copyright infringement falls on the copyright holder. As such it is your responsibility to identify your content and report it to us through a proper and documented medium, at which point we will take action to remove it in a timely manner.

At the time of writing this, I have not received a single DMCA Request for Removal from you, and since we follow the law to the letter on Desktop Nexus, we require you to take the next step and fill out our form.

Until then, there is nothing else we can do for you.

So YOU don't want to be disrespectful to your members but they can disrespect the rights of artists worldwide by uploading copyrighted images?

Also, why can they just hit upload and be done yet the OWNER of the work has to jump through hoops to prove it is theirs? Why do they not have to go through a process to prove that the work is owned by them to be able to upload? Youre "I AGREE" button on the upload page should really be changed to "I DON'T CARE"

Lets face it, all you are interested in is the revenue from advertising and the more wallpapers you have on here means more money for you irregardless of where it came from or who it belongs to.

Maybe you would not be so flippant if all the owners of the artwork offered on your website were to ask for a percentage of your profits. After all, you are using our work (without permission) so you should pay for that use !

Hi Gill,

I am the owner of Desktop Nexus. I have just deleted the previous comments from your profile and your thread from the forum. There is a proper way to handle this, and we will work with you in getting it resolved. We never want to violate anyone's copyrights, just please respect our process.

If you have found an image on Desktop Nexus that you feel is in violation of your copyright, please click the "Report This Wallpaper" tab under the preview image, then click "DMCA Copyright Violation". This will begin the process to confirm your rights to the image, as we're required by law to do (as an artist, I'm sure you're very familiar with DMCA). After the burden of proof has been established, I will present you an option. I can either delete the images completely from Desktop Nexus, adding them to a blacklist where they cannot be reuploaded again in the future, or I can transfer full ownership and control of the images to your account. If you decide to take ownership of the images, you will then have full control to modify the wallpapers however you see fit, including changing the titles, tags, description, etc. You may even include a link back to your gallery in the description of each image.

Again, we do not want to violate any copyrights, but being disrespectful towards our members is not the way to handle this situation. I'm also copying this message into a PM to you, and if you have any further issues or questions regarding the legality of images on Desktop Nexus, please deal directly with me, as I am the ONLY person who can authoritatively act on such claims.
