There is a widespread belief that trusts should only be established by the wealthy. However, this is not the case; regular men and women can establish a Trust. Furthermore, trusts are divided into two types: public trusts and private trusts. Only private trusts are governed under the Indian Trust Act of 1882. Public Trusts, on the other hand, are normally governed by state-specific legislation. The Indian Trust Act is not applicable in Jammu and Kashmir, nor in the Andaman and Nicobar Islands.
